TRAILER RENTAL AGREEMENT
This Rental Agreement ("Agreement") is made effective as of [DATE OF APPLICATION], by and between RT RENTS ("Company") and [RENTER NAME] ("Renter").
The parties agree as follows:
1. Rental
Pursuant to the terms and conditions set forth herein, Company shall provide the trailer for use by Renter.
2. Permitted Use
Renter may use the Trailer for moving, transporting, or relocating purposes only. The transportation or storage of any illegal goods or substances under federal or state law is strictly prohibited.
Renter must return the Trailer to Company’s office (or another location specified by Company) on the agreed date and time, in the same condition received, except for ordinary wear.
If returned after business hours, Renter remains responsible for the Trailer’s safety and any damage until Company inspects it on the next business day.
3. Driver’s License
Renter must be at least 21 years old and present a valid driver’s license (issued by any U.S. state, territory, or possession) covering the entire rental period.
4. Fees & Charges
Renter agrees to pay Company for all charges due under this Agreement, including but not limited to:
(a) Loss or Damage: Cost of repair, or actual cash value if not repairable or if Company elects not to repair.
(b) Cleaning Fee: $75 if Trailer is not returned in the same condition rented.
(c) Recovery Costs: Actual expenses incurred by Company to locate or repossess the Trailer.
Payment must be made with a credit, debit, or prepaid debit card in the Renter’s name (American Express, Discover, MasterCard, or Visa).
5. Insurance
At the time of rental, Renter must provide proof of vehicle liability, collision, and comprehensive insurance covering Renter, Company, and the Trailer. Company provides no additional liability insurance. Renter is responsible for all damages or losses caused to others.
6. Repossession
Company may repossess the Trailer at Renter’s expense, without notice, if the Trailer is abandoned, misused, or used in violation of law or this Agreement.
Renter agrees to indemnify and hold harmless Company from all claims, liability, costs, and attorney’s fees resulting from Renter’s use of the Trailer.
7. Damage, Loss, & Reporting
Renter is responsible for all damage to the Trailer, missing equipment, and related administrative expenses, regardless of fault.
Renter is responsible for theft, vandalism, and negligence-related losses.
Vandalism not associated with theft is limited to $500.
Renter must report all accidents, theft, or vandalism to police immediately, and to Company within 24 hours.
8. Personal Property
Company is not responsible for loss of or damage to Renter’s personal property, or that of others, carried in or left with the Trailer.
9. Condition of Trailer
Company shall provide the Trailer in clean and operable condition. Any service, repairs, or part replacements during the rental require prior approval from Company.
Renter must check and maintain tire air pressure during the rental period.
10. Driving Restrictions
The Trailer may not be operated outside the continental United States and must only be used on paved roads.
11. Waiver & Indemnification
Renter agrees, for themselves and their heirs, representatives, and assigns, to hold harmless, defend, and indemnify Company against any claims or damages (including those caused by negligence) arising from use of the Trailer.
12. Attorneys’ Fees
If legal action is required to enforce this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs.
13. Governing Law
This Agreement shall be governed by the laws of the State of Illinois, USA. If any portion is found invalid, the remaining terms remain enforceable.
14. Renter’s Responsibilities
Ensure Trailer is properly and safely connected to towing vehicle.
Verify that all lights and safety features are functioning.
Confirm that tow vehicle is properly rated and in good condition.
Note and report any pre-existing damage to Company before taking possession.

By signing below, Renter acknowledges that they have read, understood, and agree to all terms of this Agreement.
